Under Costa Rica's Child Support Act (Ley 7654) and the Family Code, the obligation to pay support generally ends when the child turns 18. However, the law explicitly recognises two exceptions that can extend this obligation beyond majority: continued higher education at a university or technical college recognised by the state (up to age 25), and a permanent disability that prevents the adult child from becoming financially independent (no age limit). Neither extension is automatic — the beneficiary must petition the Family Court and provide supporting evidence.
Costa Rica's Sala Segunda (Labour and Family Appeals Court) has consistently held that the adult child must demonstrate that university or technical studies are their principal occupation. Active enrolment and regular attendance are the baseline requirements. When the adult child also holds employment, courts evaluate whether the income is sufficient to cover basic needs: if it is not, support may be maintained or proportionally reduced rather than eliminated. A well-documented evidentiary file makes all the difference at this hearing.
When the child turns 18, the paying parent may file a termination motion (incidente de extinción) with the same court that issued the support order. The burden then shifts to the beneficiary: they must prove continued studies to avoid termination. Many young people lose support not because they are not studying, but because they — or their custodial parent — did not know to respond to the motion or failed to submit the right documents in time. This is a stage where experienced legal representation pays for itself immediately.
